Unless noted below, “we” and “us” refers to Your Business Name; and “you” and “your” refers to the Client

1. Copyright

Except as noted below, all photographs created by Your Business Name are copyright protected. It is a violation of federal copyright law to copy, scan, or allow photographs we have created to be reprinted, duplicated, digitally reproduced, copied, scanned, or altered (digitally or otherwise), without our express written permission. You agree to purchase wedding photography prints directly from us unless in possession of the digital negatives. The negatives/digital files remain our sole property until six months following your wedding date. Until then, you will have the limited right to make and use copies of the images for your own use on electronic mail and web pages. You agree not to make copies for sale or for the purpose of circumventing sale of the images by us. You also agree not to authorize any reproductions of the images for commercial use.

 

2. Exclusivity

So that you receive the best service and most compelling photos possible, we must be the exclusive professional photographer for your wedding. Additional professional photographers may be employed only with prior written permission from us. Guest photographers are welcome with one caveat: We will request your intervention if a guest is inhibiting our ability to fully document your wedding.

 


3. Limits of liability

While every reasonable effort will be made to produce and deliver outstanding photographs of the wedding events, our entire liability to you for any claim or loss arising from our performance is limited to a refund to you of the amount paid for services. Because a wedding is an uncontrolled event, we cannot guarantee delivery of any specifically requested image(s).

 

4. Permissions

It will be your responsibility to schedule and receive permission to use various locations for photography, including the wedding and reception locations and any other locations used during the day(s).

 

5. Reservation of wedding date

All retainers are non-refundable. We will reserve the time and date shown above upon signature and receipt of the required retainer. If you subsequently change the date, and if we are available on that date, a new retainer will be required to reserve the date. Upon receipt of the retainer we will reserve your date and be available to you on that date for duration not less than the amount specified in section 7. Additionally, we will not book any additional events on that date. In the unlikely occurrence of an illness or injury that prevents one or both of us from photographing your wedding, we will promptly inform you and, depending on your decision at that time, either: (a) Attempt to secure an alternate, professional photographer who will photograph your wedding on our behalf, or (b) Refund your retainer and all subsequent deposits in full.

 

6. Description of services

The parties agree that Photographer 1 & 2 (Photographer 1 only for One-photographer coverage) will furnish photographic coverage on the above date. We will provide a minimum of eight hours of photographic coverage (ten hours for Weekend/Destination coverage) on your wedding day. Weekend/Destination coverage also includes an hour of rehearsal dinner, and either an hour of Sunday brunch or a romantic “Day After” portrait session. Coverage time begins when we arrive at the first location (e.g., the salon) and ends when we leave the last location (e.g., the reception). Additional coverage can be requested at any time at the hourly rate specified in the Price List. Weddings with greater than 200 guests require Two-photographer coverage.

 

7. Payment for services.

A non-refundable retainer of one-half of the minimum investment is due at the signing of this Agreement. The retainer IS applied toward your total investment agreement. We will not reserve your wedding date until after receipt of the retainer. You may not transfer the retainer to another party, bridal couple or anyone else without our prior written consent. The final payment of one-half is due no less than fourteen days before the wedding date. Note that photography will not start until this is paid. If this Agreement is signed less than fourteen days from the wedding date, then all payments are due at signing. If the remaining balance is not paid in full two weeks prior to the scheduled date of the event, we reserve the right not to photograph the event.

8. Travel

Any applicable travel fees are due no less than fourteen days before the wedding date. Mileage between locations and from Your Town, Your State as defined by Google Maps:

  • Travel costs are billed only if the location(s) is (are) greater than 125 miles from Your Town, Your State.
  • Travel between 125 and 200 miles is billed at a flat rate of $200.
  • Domestic travel more than 200 miles is billed at a rate of $400, plus air fare if applicable. Determination of air versus car travel is solely at our discretion.
  • Fees for international travel are negotiated with the client.

9. Model release

We may only make reproductions for you or for our portfolio, samples, or self promotions, or for professional competition and review. We will not make reproductions for other use without first obtaining written permission from you.


This Agreement incorporates the entire understanding of the Parties, and the Parties agree to all its terms, and acknowledge receipt of a completed copy of the Agreement signed by all Parties. Any modifications of this Agreement must be in writing and signed by all parties. Each person signing as Client(s) below will be fully responsible for ensuring that full payment is made pursuant to the terms of this agreement. This Agreement will be governed by the laws of Your State.
